Vorgehensweise in der Kurzübersicht
I.d.R. wird zunächst eine
Gesellschaft
(Limited) auf Gibraltar installiert. Damit die einzige Betriebsstätte
und/oder/ergänzend insbesondere die steuerliche Betriebsstätte auf
Gibraltar angesiedelt ist, muss gemäß der Legaldefinition im
Doppelbesteuerungsabkommen "der Ort der geschäftlichen Oberleitung"
auf Gibraltar sein. Mithin muss ein auf Gibraltar steuerlich
ansässiger im Sinne die Geschäftsführung innehaben. Entweder verlagern
Sie -oder ein Beauftragter- Ihren Lebensmittelpunkt nach Gibraltar
oder wir stellen einen Treuhand-Direktor. Sofern Aktivgeschäfte nach
§8 AStG erwirkt werden (keine Wirkung der Hinzurechnungsbesteuerung)
können Sie bzw. Ihr deutsches Unternehmen als Mehrheits-Gesellschafter
auftreten (ansonsten empfehlen wir 50% Shares, 50% Treuhänderisch).
Ergänzend muss ein ordentlicher Geschäftssitz auf Gibraltar
installiert werden, also zustellbare Postadresse, telefonische
Erreichbarkeit usw.., ein in kaufmännischer Weise eingerichteter
Geschäftsbetrieb ist nicht erforderlich (außer Casino vor Ort).
Das Internetangebot wird bei einem
örtlichen Provider gehostet.
Nachfolgend wird die Glückspiel-Lizenz
bei der zuständigen Behörde auf Gibraltar beantragt.

GAMING TAX
For sports betting operations
gaming tax is currently levied as from 1 April 2005 at 1% of the
turnover up to £42,500,000 of annual turnover with the gaming tax
capped at £425,000 per annum, with a minimum annual tax payable of
£85,000. Betting exchanges are currently taxed on the same basis as
bookmaking operations. For internet casinos gaming tax is currently
levied at 1% of the gaming yield (the drop). The maximum and minimum
cap is the same as for sports betting.
Über Gibraltar
Gibraltar
ist ein Kalksteinfelsen, der an der Südspitze der
iberischen Halbinsel ins Meer hineinragt. Gibraltar gehört (trotz
der Lage auf dem europäischen Festland) als
Britisches Überseegebiet zum
Vereinigten Königreich Großbritannien und Nordirland.
Verhältnis zum Vereinigten
Königreich
Gibraltar ist eine Kronkolonie des
Vereinigten Königreichs. Es hat eine eigene Regierung, die die
Aufgaben der Selbstverwaltung erfüllt. Sie umfasst alle Bereiche außer
Verteidigung, Außenpolitik und innere Sicherheit, welche vom
Vereinigten Königreich übernommen werden. Staatschef ist die britische
Königin, die in Gibraltar durch einen
Gouverneur repräsentiert wird. Der Gouverneur ist gleichzeitig der
Oberbefehlshaber der Armee und der Polizei. Der momentan amtierende
Gouverneur, Sir
Francis Richards, wurde
2003
ernannt.
Politisches System
Die Bevölkerung Gibraltars wählt ein
fünfzehnköpfiges Parlament (House of Assembly), das sich nur aus
Abgeordneten der beiden stärksten Parteien zusammensetzt: Die Partei
mit den meisten Stimmen bekommt acht Parlamentssitze, der „beste
Verlierer“ erhält derer sieben. So gibt es nie eine Koalition und die
Regierungspartei wechselt oft. Der Führer der Mehrheitsfraktion wird
vom Gouverneur zum Regierungschef (Chief
Minister) ernannt. Außer dem Chief Minister besteht die Exekutive
noch aus dem Finanzminister und dem Justizminister. Zur Zeit ist
Peter Caruana von den
Gibraltar Social Democrats (GSD) Chief Minister. Er wurde
1996
gewählt und
2000 sowie
2003
wiedergewählt. Die
Gibraltar Socialist Labour Party (GSLP) ist in der Opposition.
Beide Parteien sind für Gibraltars Selbstregierung und weigern sich,
Vereinbarungen mit
Spanien
zu treffen, wobei die GSLP traditionell radikaler ist.
Status innerhalb der EU
Gibraltar ist Teil der
Europäischen Union. Aus Sicht der EU sind die Einwohner von
Gibraltar Bürger des
Vereinigten Königreichs. Es gibt jedoch einige spezifische
Ausnahmen:
Im Jahr
2003
erhielten die Bewohner Gibraltars durch den European Parliament (Representation)
Act 2003 das
Wahlrecht für das
Europäische Parlament. Gibraltar gehört bei den Europawahlen zum
Wahlgebiet Südwestengland, das sieben Vertreter nach
Straßburg entsendet. Bei den Wahlen im
Juni 2004 nahmen 57,5 % der Wahlberechtigten Gibraltars ihr neues
Recht wahr.

Beim
Glückspiel geht es um viel Geld. Für die Spieler und Wetter, aber auch
für den Staat, der in Deutschland das Glückspiel-Monopol besitzt.
Schon seit Jahren drängen private Anbieter auf den lukrativen
deutschen Markt und streiten sich mit den Bundesländern um das
Monopol.
...Auch die
staatlichen Anbieter selbst fürchten die Folgen bei einer
Liberalisierung. Horst Mentrup vom Deutschen Toto- und Lottoblock
weist auf die unterschiedlichen Bedingungen von privaten und
staatlichen Unternehmen hin: "In einem solchen Wettbewerb würden wir
mit privaten Anbietern konfrontiert, die keine oder fast überhaupt
keine Steuern zahlen, die massiv werben können, die massiv
Spielanreize setzen mit extrem hohen Ausschüttungsquoten." In einem
derartigen Wettbewerb hätten die staatlichen Anbieter "keine Chancen",
sagt Mentrup gegenüber Frontal21. In der Tat zahlt zum Beispiel
Bwin über eine Schwesterfirma in Gibraltar eine Wettsteuer in Höhe von
gerade mal einem Prozent - und selbst das nicht etwa in Deutschland.
Die staatlichen Firmen dagegen haben Abgaben von rund 40 Prozent, die
in die Kassen der Bundesländer fließen.
REMOTE GAMBLING FROM GIBRALTAR
All gaming operations in
Gibraltar require licensing under the Gaming Ordinance. Gaming
licences, including for telephone and internet betting, are issued by
the Office of the Financial and Development Secretary on behalf of the
Government.
GENERAL
The Government only licences companies with a
proven track record in gaming, of reputable standing and with a
realistic business plan. Licences are generally difficult to obtain.

Below are some of the principal
conditions and licensing requirements for sports betting and on line
casino operations.
ADVERTISING GUIDELINES
The operator shall ensure that
all advertising, promotion and sponsoring activity of whatever type
and through whatever medium (including the internet) shall be truthful
and accurate. It shall be exclusively targeted at adult players and
shall therefore not be designed to appeal in any way to minors.
Operators shall ensure that such internet websites as are used to
advertise, promote and/or operate its gaming activities shall not
include links to other sites with violent or immoral content or which
may be designed for access by minors.
The licences are issued on the
basis that the advertising and promotion of betting services can only
be directed to citizens of nations in which it is not illegal for such
activities to be undertaken and that the licence will not provide
betting services to any person where the provision of such services by
the operator would be illegal under the applicable law.
PAYOUT OF PRIZE MONIES
The operator will at all times
have adequate financing available to pay all current and reasonably
estimated prospective obligations in respect of prize payouts and to
ensure there is adequate working capital to finance on going
operations. The Operator will pay winnings and account balances to
registered players in accordance with clearly established arrangements
agreed to with the customer.
CUSTOMER PRIVACY AND DATA
PROTECTION
Operators are required to obtain
the following minimum information with regard to all prospective
customers. The basic information on each individual shall include full
name; residential address; and age as no customer may be registered as
a player if under the age of eighteen;

ACCOUNTS AND AUDIT
The bank accounts into which any
customers, funds, stakes, wagers, prizes or other monies are received,
held or paid out from shall be controlled by the Company. The
operation of any credit card merchant account used in the course of
the business shall be fully and effectively controlled by the Company.
No bank account or credit card
merchant account, nor the receipt, processing, holding and clearance
of customer funds and credit card transactions, shall be maintained by
the licence in a jurisdiction other than Gibraltar, or in a Gibraltar
licensed institution without the prior approval of the Government.
The Operator shall be required
to produce audited accounts and maintain its financial records in
accordance with the applicable law from time to time. The Operator
shall also be required to meet all its accounts and filing
requirements as set out in the Companies Ordinance, the Companies (Accounts)
Ordinance and Companies (Consolidated Accounts) Ordinance and any
other applicable legislation.
ANTI MONEY LAUNDERING
REQUIREMENTS
The Operator shall comply fully
with all obligations in respect of any transactions which may give
rise to any suspicions in respect of money laundering. The obligations
are set out under the Gibraltar Criminal Justice Ordinance and the
Anti Money Laundering Guidelines published from time to time by the
Financial Services Commission of Gibraltar.

Peter A. Isola, BA
Peter was born
in Gibraltar on the 27th December 1958. He qualified as a
Barrister-at-Law for England and Gibraltar and was called to
the Bar in 1982. He was appointed a Notary Public in 1985.
He was educated
at Stonyhurst College in Lancashire and subsequently obtained
a BA Honours Degree in Law at Kingston University, Surrey,
completing his education at the Council of Legal Education.
Peter is a
member of the Honourable Society of the Inner Temple, of the
Gibraltar Bar Association, of the International Fiscal
Association, of the International Tax Planning Association, of
the International Bar Association and of the Society of Trust
and Estate Practitioners (STEP). He is President of the
Gibraltar Chamber of Commerce and a member of the Gibraltar
Bar Council. He was the founder Chairman of the Gibraltar
branch of STEP and has served on the Gibraltar Finance Centre
Council and the Minister for Trade & Industry’s Finance Centre
Legislation Committee.
He is the
Gibraltar contributor to Tolley’s Planning and Administration
of Offshore and Onshore Trusts and Tolley’s International
Succession Laws. He has lectured on companies and trusts,

Albert was born
in Gibraltar on the 5th March 1962. He was educated at
Stonyhurst College in Lancashire and subsequently obtained his
Law Degree at Kingston University, Surrey. He completed his
education at the Council of Education in London and was called
to the Bar in 1985. He is also a Commissioner for Oaths.
Albert was
elected as a member of the Gibraltar House of Assembly in 1996
and served for four years after opting not to stand for
re-election to the local parliament at the 2000 Elections. He
is a member of the Honourable Society of the Inner Temple, the
Gibraltar Bar Association, the Reform Club in London, the
Society of Trust and Estate Practitioners and the Royal Golf
Club at Sotogrande, Spain.
Albert has
worked extensively in commercial matters both in Gibraltar and
internationally in a wide range of different matters. In
Gibraltar he has been involved in the largest commercial
property acquisition and financing transaction and has also
been engaged in a large number of residential property
developments locally. He has also led a team representing
major international banks on financing projects in Gibraltar
and in representing clients with building contractors on
property developments. Albert is also engaged extensively in
financial services and private client work.
Internationally, Albert has
been engaged and worked with teams on satellite and
telecommunication projects, property acquisitions and the
franchising of pharmaceutical products.

Gibraltar on the 30th August 1970. She was educated in
Gibraltar and subsequently obtained her Degree in English and
Spanish Law at Kent University in Canterbury. She completed
